1. Introduction
Welcome to PublicMeadowCommons ("we," "us," or "our"). These Terms & Conditions ("Terms") regulate your use of our yacht charter services as well as our website found at publicmeadowcommons.sbs (the "Service"), operated by PublicMeadowCommons.
By reserving a yacht or using our Service, you consent to these Terms. If you do not agree with any part of the terms, you should not use the Service.
2. Service Overview
PublicMeadowCommons offers elite yacht charter services, which include, but not limited to:
- Yacht rentals for the day
- Evening cruises
- Business retreats
- Private gatherings
- Extended charters
All services are provided based on availability and are subject to changes due to weather conditions. We may change or terminate services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For a charter reservation, you must:
- Have a minimum age of 18 years
- Enter truthful and complete details
- Remit the necessary deposit as outlined in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Your reservation is only affirmed after we receive your payment and send you a written confirmation. We may deny services to anyone at our discretion.
3.3 Availability
All yacht charters depend on the availability of the vessel and favorable weather conditions. We strive to accommodate your requested dates and timings as best as we can.
4. Payment Terms
4.1 Pricing
Our prices are given in € and include all applicable taxes unless stated otherwise. We reserve the right to modify prices without notice.
4.2 Payment Schedule
- Deposit: Required at 50% of the full charter cost at the time of reservation
- Remaining balance: Must be paid 48 hours prior to the charter's departure
- Extra charges (if applicable): Payable after the charter's conclusion
4.3 Payment Methods
We accept major credit cards, bank transfers, and certified checks. All payments are processed securely with encryption.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled more than 72 hours before departure: Entire refund minus processing fees
- If canceled 24-72 hours before departure: Half refund
- If canceled less than 24 hours before departure: No refund
5.2 Weather Cancellations
In case of unsafe weather as decided by our captain, we will propose to:
- Reschedule the charter without additional costs to an alternative date
- Issue a full refund if rescheduling isn't an option
5.3 Mechanical Issues
Should there be mechanical issues with the designated vessel, we'll make an effort to offer a comparable replacement. If this is not possible, we will refund the full amount.
6. Safety and Conduct
6.1 Safety Requirements
Passengers are expected to:
- Adhere to all instructions from the crew
- Use provided safety gear as needed
- Inform of any health issues that could impact their security
- Stay within specified areas on the yacht
6.2 Prohibited Items
The following are prohibited onboard:
- Glassware
- Illegal drugs
- Weapons or firearms
- Excess amounts of drinks (beyond moderate consumption)
- Pets (except if given prior approval)
6.3 Conduct
Guests should behave in a considerate manner. We have the right to halt a charter without a refund if a passenger’s conduct endangers safety or interferes with the experience of others.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the payment you made for the charter. We're not answerable for:
- Injuries caused by passenger recklessness
- Theft or damage to personal belongings
- Indirect or punitive damages
- Delays from weather or unforeseen events beyond our control
7.2 Insurance Coverage
We have comprehensive insurance for our vessels and operations. Travel and personal insurance is your own responsibility.
7.3 Assumption of Risk
By opting for our charter services, you recognize the inherent risks of maritime activities and take on accountability for your safety and welfare.
8. Modifications and Itinerary Changes
We may alter itineraries, routes, or timetables due to weather, safety, or operational necessities. We will try to provide comparable alternatives when changes are made.
9. Force Majeure
We are excused from delays, cancellations, or changes stemming from conditions beyond our control, which encompass:
- Extreme weather
- Natural calamities
- Regulatory enactments
- Port shutdowns
- Technical failures
10. Privacy and Data Protection
We manage your personal data in line with our Privacy Policy. Using our services implies your consent to our collection and use of such data as outlined in the Privacy Policy.
11. Intellectual Property
The contents of our website, including texts, imagery, logos, and other materials, are guarded by copyright and trademark laws. Unauthorized reproduction, distribution, or derivative creation is prohibited without our consent.
12. Governing Law
The enforcement of these Terms is subject to the laws of Monaco. Any disputes are to be resolved within the jurisdiction of courts in Monaco, Monaco.
13. Changes to Terms
We retain the authority to amend these Terms as necessary. Any updates will be posted on our website with a revised date of effect. Continuous engagement in our services signifies the acceptance of any revised terms.
